General Terms and Conditions of Sale

1. Subject Matter

1.1. These General Terms and Conditions of Sale (hereinafter referred to as “General Conditions”) govern the purchase of Products and Services made remotely via telematic network from the website www.italvenetadidattica.com (hereinafter referred to as the “Website”).

1.2. The owner of the Website is Italveneta Didattica S.r.l., with its registered office at Via Risorgimento 32, 30010 Pegolotte di Cona (VE) – Italy, registered with the Venice-Rovigo Chamber of Commerce, Tax Code 00881820294, VAT No. 03236270272, R.E.A. number VE 220507.

2. Acceptance of the General Terms and Conditions of Sale

2.1. All purchases of Products made through the Website (hereinafter referred to as the “Purchase Contracts”) by users who access it (hereinafter referred to as the “Clients”) are governed by these General Conditions, as well as the Italian Consumer Code (Legislative Decree No. 206/2005), Section II, Distance Contracts (Articles 50–67), and the Italian regulations on electronic commerce (Legislative Decree No. 70/2003).

2.2. By concluding a Purchase Contract following the procedure outlined, the Client accepts and agrees to comply with these General Conditions.

2.3. Therefore, the Client is required to carefully read these General Conditions before making any purchase, which Italveneta Didattica S.r.l. makes available to them to enable reproduction and storage, as required by Article 12, 3rd paragraph of Legislative Decree No. 70/2003.

2.4. Italveneta Didattica S.r.l. may modify these General Conditions at any time without notice. The General Conditions applicable to each Purchase Contract will be those published on the Website at the time the order is placed by the Client.

3. Products

3.1. www.italvenetadidattica.com is an online store selling playgrounds, furniture, psychomotor and sports equipment, recreational activities, and polystyrene and crystal creations (hereinafter referred to as “Products”).

3.2. All Products offered are fully described on the Website within their respective sections, categorized by Product type.

3.3. The visual representation of the Products on the Website, where available, is indicative and usually corresponds to the photographic image of the Products themselves. It is solely for the purpose of presentation for sale without any guarantee or commitment from Italveneta Didattica S.r.l. regarding the exact correspondence between the image shown on the Website and the actual Product, especially concerning the Product’s real dimensions and/or colour aspects of the Products and/or packaging.

3.4. In the event of any discrepancy between the image and the written product description, the latter shall prevail.

4. Purchase Procedure

4.1. The Client may purchase the Products available in the electronic catalog, thoroughly illustrated on the Website within the respective sections by product category, as described in the related product information sheets on the Website.

4.2. To purchase the Products, the Client must enter their personal details in the form that appears once they have added the products of interest, by clicking on “request a quote.” If the Client prefers not to follow this procedure, they may alternatively send an email to info@italvenetadidattica.com, specifying the item, quantity, and personal details.

4.3. The Client will be contacted to identify any additional needs, such as transport cost estimates, payment methods, and order fulfillment times. The order will then be managed directly by Italveneta Didattica S.r.l.

5. Contract Conclusion

5.1. The publication of the Products displayed on the Website constitutes an invitation to the Client to submit a purchase offer. The order sent by the Client represents a contractual offer and entails the complete understanding and full acceptance of these General Conditions.

5.2. Each Purchase Contract entered into between Italveneta Didattica S.r.l. and the Client shall be deemed concluded with the acceptance of the order by Italveneta Didattica S.r.l., which will be sent to the Client’s email address. This confirmation message will contain an “Order Number,” to be used in all future communications with Italveneta Didattica S.r.l. The message will also include, in addition to the legally required information, all the data provided by the Client, who undertakes to verify their correctness and promptly notify any corrections. Additional costs arising from errors in the data not reported in a timely manner shall be borne solely by the Client.

5.3. Each order can be viewed by the Client on the Website in their personal area if they are registered or by contacting Italveneta Didattica S.r.l.’s Customer Service immediately after sending the order.

5.4. It is possible that occasional unavailability of the Products offered may occur. In such cases, if the Products chosen by the Client are not entirely or partially available, the order will be sent with the available Products after notifying the Client regarding the unavailable Products.

5.5. Italveneta Didattica S.r.l. reserves the right to accept or decline the order sent by the Client at its sole discretion, without the latter being able to make any claims or assert any rights whatsoever, including compensation, in the event of non-acceptance of the order.

5.6. In particular, Italveneta Didattica S.r.l. reserves the right not to accept purchase offers and to cancel orders that do not provide sufficient solvency guarantees or if anomalies are detected in the transactions or payment methods used by the Client.

5.7. The Client may verify the contents of the concluded purchase contracts at any time by accessing their personal area on the Website, provided they are registered, or by contacting Italveneta Didattica S.r.l.’s Customer Service. These data will be available for a period of 12 months from the delivery of the Products.

6. Product Prices

All prices for the Products must be agreed upon through direct contact with the manufacturer Italveneta Didattica S.r.l. Delivery costs are to be agreed upon at the time of the order. The cost of each shipment may vary depending on the delivery method, payment method, destination, and the total amount of the order.

7. Non-Conformity of Products and Defective Products

7.1. The Products offered on the Website comply with national and European legislation. The images and colors of the Products published on the Website may differ from the actual ones due to local settings of systems and/or tools used for their display.

7.2. In the event of non-conformity of the Products purchased concerning the description published on the Website, or in the case of defective or damaged Products, the Client is requested to contact the manufacturer by sending photographic evidence of the damage or non-conformity of the Product through the Customer Service section on the Website.

7.3. Italveneta Didattica S.r.l.’s staff will then provide instructions on the refund procedure, which may include, at the Client’s discretion, discount vouchers for future purchases of a value higher than the amount to be refunded. Italveneta Didattica S.r.l. shall not be held liable for any further compensation.

7.4. In any case, the provisions regarding the legal guarantee of conformity of goods as provided by the Italian Consumer Code (Legislative Decree 206/2005, Part IV, Articles 102–135) remain applicable.

8. Processing of Personal Data

The Clients’ personal data are processed by Italveneta Didattica S.r.l. in accordance with the applicable laws on the protection of personal data, as specified in the “Privacy Policy” section of the Website.

9. Communications and Complaints

All communications or any complaints from the Client to Italveneta Didattica S.r.l. concerning the Purchase Contracts must be communicated through the appropriate contact forms available within the Reserved Area.

10. Online Dispute Resolution for Consumers

European consumers should be aware that the European Commission has set up an online platform that provides an alternative dispute resolution tool. This tool can be used by European consumers to resolve, non-judicially, any dispute related to and/or arising from contracts for the sale of goods and services entered into online. 11. Intellectual Property Rights

All trademarks (whether registered or not), as well as any intellectual work, distinctive sign, or name, image, photograph, written or graphic text, and in general any other intangible asset protected by intellectual property laws and international conventions reproduced on the Website, remain the exclusive property of Italveneta Didattica S.r.l. and/or its licensors, without the Client having any right thereto as a result of accessing the Website and/or entering into Purchase Contracts. Any use, even partial, of these assets is prohibited without prior written authorization from Italveneta Didattica S.r.l., in favor of which all related rights are exclusively reserved.

12. Applicable Law and Jurisdiction

12.1 These General Conditions and any contract concluded with the Client shall be governed by Italian law, without prejudice to the application of European Union legislation and international treaties, where applicable, as well as national consumer protection legislation.

12.2 For any dispute regarding the interpretation, execution, validity, or effectiveness of these General Conditions and any contract concluded with Clients, the Court of the registered office of Italveneta Didattica S.r.l. shall have exclusive jurisdiction.

Italveneta Didattica S.r.l. will issue a receipt or invoice for the Products purchased by the end of the current month in which the purchase was made, sending it via email to the Client. The information provided by the Client will be used to issue the receipt or invoice, and no changes can be made to the details after the issuance of the receipt or invoice.

The order handling costs vary depending on the payment method chosen:

• Bank Transfer: FREE
• RI.BA: Starting from €3.50 (excluding VAT) depending on the order amount.

Bank Transfer Payment

The Client may pay by bank transfer to the account specified in the order within the time agreed at the time of purchase. Payment by bank transfer involves different delivery times compared to other payment methods. These times (at least 6-7 days) are due to the need for www.italvenetadidattica.com to verify that the payment has been made. To expedite verification of the payment and the subsequent dispatch of the order, the Client may send the CRO code (transaction reference code) or a copy of the transfer receipt to info@italvenetadidattica.com.

Shipping Costs and Times

Italveneta Didattica S.r.l. is committed to handling shipments promptly, considering product availability in stock and their procurement. Except for large-quantity orders, the average order fulfillment time is generally 5-7 business days from the receipt of final confirmation and according to the agreements made during purchase.

Shipping costs may vary based on the geographical area and order volume. Therefore, Italveneta Didattica S.r.l. is committed to offering the most advantageous and appropriate shipping solution for the Client’s needs, using the services of various national and international couriers.

Delivery Methods

Italveneta Didattica S.r.l. commits to delivering goods without undue delay and, in any case, no later than thirty working days from the conclusion of the contract. The delivery of Products will be carried out by courier, and the times will vary depending on the destination. The terms indicated at the time of the purchase order are indicative.

The delivery will take place without prior appointment unless otherwise agreed during the purchase process. Italveneta Didattica S.r.l. will not be liable in any way for delays in fulfilling the order or delivering the Products subject to the Purchase Contracts.

The Products ordered will be sent to the postal address specified by the Client. Once the Products are handed over to the courier, the Client will receive a shipment confirmation email. Deliveries will take place from Monday to Friday, during standard office hours, excluding national holidays, according to the courier chosen by the Client.

Delivery is considered completed when the Product is made available to the Client at the address specified in the order form. If delivery cannot be completed due to the recipient’s absence, the courier will send an email notification to the company, and a second delivery attempt will be made according to the courier’s procedures.

If a second delivery cannot be made due to the recipient’s absence, Italveneta Didattica S.r.l.’s Customer Service will contact the Client to arrange a further delivery attempt. If the Client cannot be contacted within 10 days or if delivery remains unsuccessful due to the recipient’s absence, the Products will be returned to Italveneta Didattica S.r.l.

Upon delivery of the Products by the courier, the Client is required to carefully check:
a) That the anti-tampering seal is intact and that the packaging is not damaged or altered.
b) That the number of pieces delivered matches what is indicated in the transport document.

Any damage to the anti-tampering seal, the packaging, or the Products, or any discrepancies in the number of pieces/packages or the indicated information, must be immediately reported by the Client. The Client may contact Italveneta Didattica S.r.l.’s Customer Service, specifying the order for which such discrepancies occurred.

Events such as force majeure, lack of transportation, unforeseeable or unavoidable events that result in delayed deliveries, or make deliveries difficult or impossible, or that cause a significant increase in delivery costs charged to Italveneta Didattica S.r.l., entitle the company to split, postpone, or cancel the delivery, in whole or in part, or to terminate the Purchase Contract.

The Client is required to agree with Italveneta Didattica S.r.l. on the procedures for obtaining a return or withdrawal, which will only be accepted upon demonstrating the non-conformity of the Product or Service provided compared to the terms specified in the offer or sales conditions. In such cases, documentary proof of the Product’s unsuitability will be required, and Italveneta Didattica S.r.l. reserves the right to assess and verify the reported issues before proceeding with accepting the return or withdrawal request. Any shipping costs for the Product’s return will be borne by the Client unless otherwise agreed between the parties.
